1. Acceptance of terms
By accessing or using BabyTracker (the "Service"), including the iOS application and the website at baby-tracking.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of service
BabyTracker is a baby care tracking application that allows parents and caregivers to log feedings, sleep, diaper changes, mood, growth measurements, and milestones. The Service includes data visualization, statistics, and optional AI-powered insights.
3. Account registration
To use BabyTracker, you must:
- Be at least 16 years of age
- Provide a valid email address
- Create a secure password
- Provide accurate and complete information
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users' data
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious content or attempt to exploit the Service
- Create multiple accounts to circumvent usage limits
- Use automated tools to access the Service without our permission
- Share your account credentials with others (use the family invitation feature instead)
5. Medical disclaimer
BabyTracker is NOT a medical device and does NOT provide medical advice.
The Service is a tracking and informational tool only. All data, statistics, insights, and AI-generated suggestions are for informational purposes and should not be relied upon as medical advice, diagnosis, or treatment recommendations.
Always consult your pediatrician or qualified healthcare provider with any questions about your child's health, development, or well-being. Never disregard professional medical advice or delay seeking it because of information provided by this Service.
In case of a medical emergency, call your local emergency services immediately. Do not rely on this Service for emergency medical situations.
6. AI features disclaimer
The AI assistant feature uses artificial intelligence to analyze your tracking data and provide suggestions. You acknowledge that:
- AI-generated responses may be inaccurate, incomplete, or misleading
- The AI does not have access to your child's medical history or perform physical examinations
- AI suggestions should be used as a starting point for discussion with your healthcare provider, not as definitive guidance
- We do not guarantee the accuracy, reliability, or completeness of AI-generated content
7. Family sharing
When you invite family members or caregivers to your family group, they will have access to view and contribute to your baby's activity data. You are responsible for managing who has access to your family group. You can remove members at any time through the app settings.
8. Subscriptions & payments
BabyTracker offers free and paid plans. For paid plans:
- Payments are processed through Apple's App Store
- Subscriptions auto-renew unless canceled before the renewal date
- You can manage or cancel your subscription at any time through Settings → Apple ID → Subscriptions on your iOS device
- Refund requests are handled per Apple's App Store refund policy
9. Intellectual property
The BabyTracker name, logo, and all related content, features, and functionality are owned by us and protected by copyright and other intellectual property laws. You retain ownership of the data you enter into the Service.
10. Limitation of liability
To the maximum extent permitted by applicable law, BabyTracker and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or data inaccuracies
- Decisions made based on information provided by the Service
- Service interruptions or downtime
- Any health-related outcomes related to use of the Service
- Loss of profits, goodwill, or other intangible losses
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Account termination
You may delete your account at any time by contacting us at support@baby-tracking.ai. We may suspend or terminate your account if:
- You violate these Terms of Service
- Your use of the Service poses a security risk
- We are required to do so by law
- The Service is discontinued (with reasonable notice)
Upon termination, your data will be handled in accordance with our Privacy Policy.
13. Governing law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Germany.
14. Changes to terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
